I. Application of the general conditions of sale
1.1. These general conditions of sale are brought to the attention of each customer in order to enable him to place an order.
1.2. Consequently, placing an order implies the complete understanding and acceptance of the general conditions of sale by the customer.
1.3. No exceptions to these conditions will be accepted without the consent of Cacao et Chocolat.
1.4. The customer therefore cannot oppose any condition set by Cacao et Chocolat, unless Cacao et Chocolat agrees to this exception.
1.5. Cacao et Chocolat will respect all the terms and conditions stated in this section, however, we reserve the right to change any of the terms at any given time.
II. Orders and confirmations
2.1. The customer is requested to complete the order form accurately and to provide information in various headings (his address, the delivery address, the method of payment, etc.). Should there be any error in the details provided for the recipient, Cacao et Chocolat cannot be held responsible for the failure to deliver to that recipient. Charges related to forwarding or reshipping the package to another recipient or to a different delivery address will be the responsibility of the customer.
2.2. Each order placed on the website is subject to approval by Cacao et Chocolat. Cacao et Chocolat reserves the right to refuse an order if the customer does not provide all the information requested or the product or products ordered are not available. In which case, the customer will be notified within 48 hours from the date on which the order was placed.
2.3. The right of withdrawal of 7 days does not apply to contracts for the supply of perishable food products such as chocolates. For this reason, the customer may not make use of this right. Modification or cancellation by the customer may be accepted while the parcel is in preparation. In case of cancellation, the charges will be refunded. However, a 10 € fee will be applied for administrative cancellation charges.
2.4. On the other hand, from the time the parcel is handed over to the carrier, no modifications or cancellations may be accepted and the charges will not be refunded.
III. Prices
3.1. The prices indicated on the order form are in Euros after tax, from our boutique in Paris. The French VAT rate of 5,5 % and 19.6 % are applied to orders destined for mainland France, Corsica, the Overseas Departments and European Union countries.
IV. Order payments
4.1. Payments are made and charged immediately using the following credit cards: Carte Bleue, Visa, MasterCard. For this reason, there are neither discounts nor penalties for late payment.
4.2. The currency used for the transaction is the Euro. The amount, debited from the account of the credit card holder, will depend on the exchange rate of the Euro on the day of the debit and any exchange charges made by the bank that issued the card.
4.3. To be registered, the order must be paid for in full. Orders not paid for cannot be delivered.
4.4. The customer must indicate the number of his card, together with expiration date in the area provided for this purpose and the visual cryptogram situated in the back of the card. The payment security protocol used (SSL or Experian Pay Life) guarantees the total confidentiality of the personal information transmitted on the Internet.
V. Unavailability of the products
The availability of the products and services is indicated on the Website. However, it will only become firm when the order is confirmed.
Cacao et Chocolat cannot be held responsible for the unavailability of a product for delivery especially that La Maison du Chocolat ascertains that the customer is informed prior to the delivery of his order.
VI. Delivery of the products
6.1. Preparation and shipping of products
6.1.1. Parcels are prepared and packed by Cacao et Chocolat in a sealed, shock resistant package which protects the contents during transportation.
6.1.2. The customer is responsible for the indications relating to the name and address of the recipient which must be accurate, precise and complete (Door code, floor, Telephone, etc…) to enable proper delivery. Cacao et Chocolat cannot be held responsible for any packages return of a delivery due to an erroneous address or the impossibility of delivering to the address indicated. If the return of delivery or the impossibility to deliver results from a lack of information or a mistake in the delivery address, the second delivery will be charged entirely to the cutomer.
6.1.3. WARNING: Orders which indicate an address to a Post Office Box cannot be accepted.
The following destinations are exceptions to this rule: Andorra and Overseas Departments.
6.1.4. Cacao et Chocolat undertakes to process and ship the order to the requested address, via a carrier it chooses.
Cacao et Chocolat will insure the goods up to delivery; however, it is up to the customer to verify the parcel in the presence of the delivery agent. Any discrepancy on delivery must be pointed out on the delivery notice. If this clause is not respected, no reimbursement process for obtaining credit from the carrier will be initiated.
6.1.5. Should the recipient or a person able to accept the delivery of the products be absent, the carrier will leave a notification of the delivery at the delivery address indicated by the customer asking him to claim the products. Under no circumstances can Cacao et Chocolat be held responsible for any damage to the products resulting from their late recovery from the carrier.
6.1.6. The logistics centre for the preparation of the orders is at the following address:

You have to select the country of delivery in order to know the delivery charges. By providing this information, the shipping charges are automatically calculated based on the delivery zone and the weight of the package. A price list of the shipping charges is available for review on the website.
6.2. Delivery times
6.2.1. Delivery times depend on the country of delivery and period of Year.
6.2.2. No deliveries will be made on Sundays.
NB :
- All the orders placed on Friday, Saturday or Sunday will be shipped on the coming Monday and therefore delivered only from Tuesday.
- During busy season (from the 15th to the 24th of December), delivery times may not be respected.
VII. Transfer of ownership - transfer of risk
7.1. The transfer of ownership of the products to the customer only takes effect after the customer has paid the price in full.
7.2. Cacao et Chocolat insures the risks of loss and damage to the products up to the delivery of the said products to the addressee. The transfer of risk is therefore made from the time the addressee has acknowledged receipt of the products.
VIII. Complaints - Disputes
8.1. Complaints or disputes will always be received with attentive goodwill, with the good faith of the person who has taken the trouble to set out the claim always being presumed.
8.2. On reception of the products, the customer must always check that the delivery is in conformity with his order. Any damage must be noted accurately, dated and signed on the delivery note.
8.3. Any claims must be made within a maximum time of 48 hours after reception, to the Customer Service department of Cacao et Chocolat by registered letter with acknowledgement of receipt or by e-mail to :

After this period, no claims will be accepted.
8.4. The reason for the claim must be stated and accompanied by evidence justifying the prejudice suffered (transport document, etc.). Following an analysis and acceptance of the complaint by Cacao et Chocolat, the customer may choose between reimbursement of his order or a second delivery.
IX. Returns
9.1. Any return of a product must be formally agreed between Cacao et Chocolat and the customer and be returned within 48 hours of the agreement. After this period, no returns will be accepted.
9.2. Any return accepted by Cacao et Chocolat because of a visible fault or the non conformity of the products delivered ascertained by Cacao et Chocolat will enable the customer to receive a free replacement or the restitution of a credit note in his favour, with the exclusion of any other form of indemnity or the payment of damages and interest.
X. Right of access and rectification
10.1. Deontology In the interests of protecting your private life, Cacao et Chocolat processes all the information concerning you in the strictest confidentiality. When you make purchases, we only ask you for essential information (surname, first name, mail and e-mail addresses) to enable high quality processing and the attentive monitoring of your order. This data entered on line is recorded on a secure server and are immediately encrypted.
10.2. Your rights
In accordance with the law on Computers and Individual Liberties dated 6th January 1978, you have the right of access to the data concerning you and of rectifying it. Through us you may receive offers from other Companies or bodies or else be informed of our special offers by e-mail or letter. 10.3. Our duties
We declare all of our files to the "Commission Nationale de l'Informatique et des Libertés" (National Commission for Computers and Individual Liberties).
XI. Garantee
Cacao et Chocolat guarantees the quality and freshness of its products for three weeks from the date of despatch from Paris, on condition that the conditions of conservation indicated in the leaflet attached to the parcel have been respected.
XII. Interdictions
Under no circumstances may the customer sell the products which are intended for his personal use or that of the person to whom his order is addressed.
